3-2-3: MUNICIPAL OFF-SALE LIQUOR STORE:
   A.    Establishment: There is hereby established a Municipal liquor dispensary for the off-sale of intoxicating liquor within the City. No intoxicating liquor may be sold at retail elsewhere in the City or by anyone not employed in the dispensary, except that the on-sale of such intoxicating liquor may be permitted in such clubs, hotels, motels, restaurants and other lawful establishments as may be authorized by the City Council.
   B.    Location And Operation: The Municipal liquor dispensary shall be at such place as the City Council shall by motion determine and may be either leased or owned by the Municipality. It shall be in charge of a person known as the Manager, who shall also be selected by the City Council and shall be paid such compensation as the Council shall determine. The Manager shall have full charge of the operation of such store, and shall have authority to purchase supplies as are necessary and employ such additional help as he may need at a rate of compensation to be approved by the City Council and under rules to be determined by the Council. All employees including the Manager shall hold their positions at the pleasure of the Council. No minor shall be employed in the Municipal store.
   C.    Qualifications Of A Liquor Store Manager: The Manager of such liquor store shall be a person, not less than twenty one (21) years old and a resident of the Municipality. He shall furnish to the City before entering upon his duties as such Manager a good and sufficient corporate surety bond in the sum of ten thousand dollars ($10,000.00) conditioned upon his faithful performance of his duties as such Manager. He shall, with the consent and approval of the Council, designate a Deputy Manager who shall operate such Municipal liquor store in the event of the Manager's temporary disability of inability to act as such Manager.    D.    Creation Of Liquor Store Committee: There is hereby created a Liquor Store Committee to be appointed annually by the Mayor. The committee is to be composed of two (2) members of the City Council, one of whom shall act as a Chairman of the committee. Such committee shall supervise all purchases and the operation of the liquor store and make reports thereon to the Council and do other such acts as may be necessary to carry out the provisions of this chapter.    E.    Liquor Store Fund Created: A Liquor Store Fund is hereby created into which all revenue received from the operation of the store shall be paid, and from which all operating expenses shall be paid; provided, that the initial costs of rent, fixtures, and stock may be paid for out of the General Fund of the Municipality, but such amounts shall be reimbursed to said General Fund out of the first monies coming into the Liquor Store Fund not needed for carrying on the said business. Any surplus accumulating in this fund may be transferred to the General Fund by resolution of the Council and expended for any Municipal purpose. (Ord. 171, 1-11-1982)
