3-2-2: DEFINITIONS:
Terms as used in this Chapter shall mean:
BEER STORE: An establishment used exclusively for the sale of 3.2 percent malt liquor at retail either on-sale or off-sale, or a combination of on-sale and off-sale, and under the control of an individual owner or manager and as an incident thereof, may also sell cigars, cigarettes, ice, all forms of tobacco, soft drinks and/or food at retail.
CLUB: Any corporation duly organized under the laws of the State for civic, fraternal, social or business purposes or for intellectual improvement, or for the promotion of sports, or a congressionally chartered veterans' organization, which shall have more than fifty (50) members and which shall, for more than a year, have owned, hired, or leased a building or space in a building of such extent and character as may be suitable and adequate for the reasonable and comfortable accommodation of its members, and whose affairs and management are conducted by the board of directors, executive committee, or other similar body chosen by the members at a meeting held for that purpose, none of whose members, officers, agents or employees are paid directly or indirectly any compensation by way of profit from the distribution or sale of beverages to the members of the club, or its guests, beyond the amount of such reasonable salary or wages as may be fixed and voted each year by the directors or other governing body.
HOTEL: An establishment where food and lodging are regularly furnished to transients and which has:
   A.    A resident proprietor or manager;
   B.    A dining room serving the general public at tables and having facilities for seating at least thirty (30) guests at one time; and
   C.    Guest rooms in the following minimum numbers: in first class cities, fifty (50); in second class cities, twenty five (25); in all other cities, ten (10).
INTOXICATING LIQUOR: Ethyl alcohol, distilled, fermented, spirituous, vinous, and malt beverages containing more than 3.2 percent of alcohol by weight.
MOTEL: Any establishment having a resident proprietor or manager, wherein consideration of payment therefor, food and lodging are regularly furnished to transients, having as one of its features drive-in facilities whereby the transients who are lodging therein may drive up to the unit in which they are lodged for the night, and which maintains for the use of its guests not less than one hundred (100) separate and distinct guest units for lodgers and which employs an adequate staff to provide more suitable and usual service and which maintains under the same management and control as the rest of the establishment as an integral part thereof a dining room with appropriate facilities for seating not less than fifty (50) guests at one time where the general public is, in consideration of payment thereof, served with meals at tables.
NONINTOXICATING MALT LIQUOR: Malt liquor containing not less than 0.5 percent alcohol by volume nor more than 3.2 percent alcohol by weight.
OFF-SALE: The sale of alcoholic beverages in original packages for consumption off the licensed premises only.
ON-SALE: The sale of alcoholic beverages for consumption on the licensed premises only.
RESTAURANT: Any establishment, other than a hotel or motel under the control of a single proprietor or manager, having appropriate facilities for the serving of meals and for seating not less than twenty five (25) guests at one time, and where, in consideration of payment therefor, meals are regularly served at tables to the general public, and which employs an adequate staff to provide the usual and suitable services to its guests.
