5-4-1: DEFINITIONS:
As used in this chapter, the terms shall mean the following:
AT LARGE: A dog, cat, or animal shall be termed at large when such dog, cat, or animal is not under "restraint", as defined herein.
DANGEROUS ANIMAL: Any animal that:
   A.    Has known propensity, tendency or disposition to attack unprovoked, causing injury, or otherwise threatening the safety of humans or domestic animals; or
   B.    When unprovoked, inflicts bites on a human or domestic animal on public or private property; or
   C.    When unprovoked, chases or approaches a person, including, but not limited to, a person on a bicycle, upon the streets, sidewalks, or public or private property, other than the animal owner's property, in an apparent attitude of attack.
DOMESTIC ANIMAL: Includes, but is not limited to, dogs, cats, rabbits, ferrets, mice, hamsters, nonprotected birds commonly kept as pets, nonpoisonous and nonconstrictor snakes, nonpoisonous reptiles (excluding those defined as exotic animals), or other animals commonly found for sale as pets and not otherwise excluded by this chapter.
HARBORER: Any person who has custody of any domestic animal or permits the domestic animal to be kept on or stay on or about the harborer's premises.
KENNEL: Any place four (4) or more dogs or four (4) or more cats over six (6) months of age are kept in a single location for breeding, hunting, show, training, field trials, exhibition purposes, or as personal pets. (An annual kennel license is required for any place where 4 or more dogs and/or cats over 6 months of age are kept.)
LIVESTOCK: Domesticated animals or birds that may be kept or raised in pens, houses, pastures, or on farms as part of an agricultural or farming operation, whether for commerce or private use.
OWNER: Any person, group of persons, or legal entity owning, keeping or harboring a domestic animal(s).
POLICE: The police officers of the city, or any person, firm, or agency hired or engaged by the city to assist the police in the performance of their duties.
POTENTIALLY DANGEROUS ANIMAL: Any animal that:
   A.    When unprovoked, inflicts bites on a human or domestic animal on public or private property;
   B.    When unprovoked, chases or approaches a person, including a person on a bicycle, upon the streets, sidewalks, or any public or private property, other than the dog owner's property, in an apparent attitude of attack; or
   C.    Has a known propensity, tendency, or disposition to attack unprovoked, causing injury or otherwise threatening the safety of humans or domestic animals.
RESTRAINT: A dog, cat, or animal is under restraint if it is controlled by a leash not exceeding eight feet (8') in length; or if it is within the boundaries of the owner's or harborer's premises. (Ord. 243, 4-23-2007)
