The fire chief shall have the sole command and control over all persons connected with the fire department and shall possess full power and authority over its organization, government and discipline and to that end, may from time to time establish such disciplinary rules and regulations as he may deem advisable, subject to the approval of the council including recertification requirements. He shall have charge of and be responsible for the engines and other apparatus and the property of the city furnished the fire department, and see that they are at all times ready for use in the extinguishing of fires. The assistant chief shall aid the chief in the work of the department and in his absence, shall perform his duties. (Ord. 703, 4-19-1982)
No person who is authorized by the city to receive any report of fire or who agrees to receive and transmit such report to the fire department shall be liable in any civil action for damage to property or persons, including death, caused by delay in reporting or failure to report such fire, unless such delay or failure is the result of gross negligence of such person. (Ord. 703, 4-19-1982)
It shall be unlawful for any person to give a false alarm, with intent to deceive or to pull the lever of any signal box except in case of fire, or tamper in any way with the box or any part thereof, or to injure, deface or remove any of the boxes or the wires or supports thereof connected with any part of the alarm system; or to use the telephone mischievously, wilfully or wantonly without having reasonable grounds for believing that a fire exists, to give any alarm to the fire department. (A) A mutual aid agreement is an agreement for protection against natural or manmade disasters.
(B) The Mayor may negotiate and, upon approval of the council, enter such agreements with the proper authority of:
(1) Other incorporated municipalities.
(2) Fire districts.
(3) Unincorporated municipalities.
(4) State agencies which have fire protection services.
