If the owner of any premises in front of or along which any sidewalk or curb has been ordered constructed in the manner herein provided shall fail, neglect or refuse to construct the same for a period of thirty (30) days after the date of the first publication of such notice, or for a period of thirty (30) days after the date of mailing of such notice, the engineer may, by written order, direct the sidewalk and curb contractor to construct the same and said sidewalk and curb contractor shall, within forty five (45) days after receiving such written order, construct and fully complete the same in accordance with the terms and conditions of his contract with the city in force at the time of such construction, and the cost of such construction together with all expenses connected therewith shall be assessed against the premises in front of or along which such sidewalk or curb is constructed and shall be collected in the manner prescribed by law.
