Whenever any street, alley, public way or utility easement or right of way or any portion thereof in the city shall be obstructed by any fences, buildings or other structures of any kind, or other obstructions; the obstruction is hereby declared to be a public nuisance provided the council shall have annexed or incorporated the said property into the city and accepted the dedication to the public of the streets, alleys, public ways, utilities, easement or right of way.
