The definitions contained in § 53.02 are hereby incorporated in this chapter. For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
CONNECTION. Any ditch, pipe, or other device for the diversion or transmission of stormwater which will in any way affect the operation or maintenance of the City’s storm sewer system.
ILLEGAL DISCHARGE. Any discharge to the City’s storm sewer system that is not composed entirely of stormwater.
NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES). A permitting system established by § 402 of the Federal Clean Water Act, 33 U.S.C. §§ 1251 et seq.
PERSON. Any individual, partnership, firm, company, corporation, association, joint stock company, trust, estate, governmental entity, or their legal representative agents or assigns.
POLLUTANT. Any pollutant or combination of pollutants listed as toxic in any North Carolina statute or regulation, or in regulations promulgated by the administrator of the Environmental Protection Agency under the provisions of § 402 of the Federal Clean Water Act, 33 U.S.C. §§ 1251 et seq.
STORM SEWER SYSTEM. A publicly-owned or operated conveyance or system of stormwater runoff conveyances (including roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches, manmade channels, or storm drains).
STORMWATER. The flow of water that occurs during and following any form of precipitation.
SURFACE WATER. The flow of water or other liquids from either precipitation or human activities across the surface of the ground.
