(a) No railroad company shall obstruct or permit or cause to be obstructed a public street, road or highway by permitting railroad grade crossing protective gates to block roadways within the Village of Haskins for longer than five minutes.
No railroad company shall fail at the end of each five minute period of obstruction of a public street, road or highway to cause such a public street, road or highway to be free of the closed gates and open so to allow the passage of persons and vehicles waiting to cross.
(b) This section does not apply to obstructions of a public street, road or highway by a railroad grade crossing protective gate, the result of said obstruction being the result of a continuously moving train.
(c) Upon the filing of an affidavit or complaint for violation of this section, summons shall be issued to the railroad company pursuant to Ohio R.C. 2935.10(b) which summons shall be served on the regular ticket or freight agent of the company in the county where the offense occurred.
(d) For purposes of this section, “railroad company” includes the officers, employees and agents of such company.
(e) Whoever violates this section is guilty of a minor misdemeanor. The maximum penalty for this offense is an organization fine not to exceed one thousand dollars ($1,000).
