(a) No person under thirteen (13) years of age shall be in or upon any public place within the Village during the period ending at 5:00 a.m. and beginning at 10:30 p.m. daily.
(b) No person aged thirteen (13) to seventeen (17) years shall be in or upon any public place within the Village during the period ending at 5:00 a.m. beginning at 12:00 midnight daily.
(c) Any person violating this section shall be adjudicated an unruly child and shall be subject to the disposition alternatives set forth in Ohio R.C. 2151.354.
(d) It shall be an affirmative defense to this section that, at the time of the violation:
(1) The minor was accompanied by a parent or guardian.
(2) The minor is in violation of this division due to unreasonable necessity.
(3) The minor is returning home by direct route from an official school, religious or civic activity, or from employment.
(4) The minor is engaged in interstate travel with consent of the minor’s parent or guardian.
(5) The minor is engaged in the exercise of rights protected by the First Amendment to the United States Constitution and Article I, Section 3 and Section 11 of the Ohio Constitution.
(e) As used in this section, “public place” shall mean any street, highway, alley or right of way, including sidewalks; any park, playground, place or building open to the public; any privately owned place of public accommodation, including parking lots; and any vacant lot or land or, without the consent of the owner, any private property.
