(A) No tank car or other portable storage or transportation device having a storage capacity in excess of 500 gallons, or, in the case of dry materials, 1,000 pounds, and containing hazardous materials shall be allowed to remain in the corporate limits within 300 feet from any residence, business, school or any place open to the public, except for the purpose of loading or unloading hazardous materials, but in no event shall said tank car or portable storage transportation device be allowed to remain within said 300 feet for longer than 14 days unless:
(1) The owner obtains authorization from the City Council; and
(2) The tank, receptacle or storage device is in safe condition (e.g., is not leaking) and meets the safety requirements of all applicable state, federal and local laws, ordinances, rules and regulations.
(B) Any tank car or other portable storage or transportation device in violation of this provision is hereby declared a nuisance subject to abatement according to the procedure in § 92.16 of this code and/or if located on a highway, subject to removal under the procedure set forth in § 71.16 of this code.
