§ 52.02 WATER COMMISSIONER AUTHORITY.

   (A)   The Water Commissioner shall have the authority to issue any order consistent with the provisions of this code in order to protect the public health and safety. Any order of the Water Commissioner shall be in writing and shall clearly state the nature of the order, compliance requirements and set a reasonable date by which compliance must be met. All orders will be mailed to the customer by first class mail, return receipt requested or by personal service.

   (B)   With the exception of willful or malicious acts, the city shall defend and hold harmless the Water Commissioner for his or her acts and doings while carrying out or purporting to carry out his or her responsibilities under §§ 52.35 through 52.44 of this code.
