§ 33.03 INDEMNIFICATION OF CITY OFFICIALS, OFFICERS AND EMPLOYEES.
   (A)   Terms of limits of indemnification. Beginning at 12:01 a.m., EST, on January 1, 1986, and thereafter, the city hereby does and shall indemnify all elected officials, duly-appointed officers and employees of the city for the commission or incurrence of any and all errors, omissions, liabilities and damages assessed for violations of civil rights assessed by any court or agency of proper jurisdiction of the state or of any other state of the United States or foreign state, provided, however, that such errors, omissions, liabilities or damages for violations of civil rights are not committed or incurred with malfeasance or gross negligence by the elected official, duly- appointed officer or employee of the city.

   (B)   Approved methods and means.
      (1)   The Board of Public Works and Safety of the city shall procure insurance coverage from a reputable carrier, duly licensed to sell insurance in the state, covering against and indemnifying the city, elected officials of the city, duly-appointed officers of the city and employees of the city for errors, omissions, liabilities and violations of civil rights when the Common Council of the city has made current budget appropriations in the amount sufficient to obtain reasonable coverage and when the coverage becomes available through competitive bid procedures for the amount duly appropriated.
      (2)   When coverage does not become available, or in the eventuality of coverage being available and obtained in an amount insufficient to indemnify the city, elected officials of the city, duly- appointed officers of the city or employees of the city, the city shall assure indemnification in an amount to meet the total sum assessed as damages or liabilities by the court or agency of proper jurisdiction, the city, duly-appointed officers of the city or employees of the city, in the full amount of the damages or liabilities assessed.
