§ 30.25 ELECTION OF COMMON COUNCIL MEMBERS.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      CITY. The City of Hartford City, Indiana.
      COUNCIL. The Common Council of the city.
      PRECINCT. The precinct by that name, as established by the County Board of Commissioners and approved by the State Election Board under I.C. 3-11-1.5, which is in existence on the effective date of this section.

   (B)   Voting for Council members. The Council is composed of five members. Each voter of the city may vote for one candidate for at-large membership and for one candidate from the district in which the voter resides.

   (C)   Council districts. The Council divides the city into districts for the purpose of conducting elections of Council members. See Exhibit “A,” which is attached to the ordinance codified herein and made a part hereof by reference as if set out herein in full.

   (D)   Areas not included in a district. If any part of the city is not included in one of the districts established by division (C) above, then that territory is included within the district which:
      (1)   Is contiguous to that territory; and
      (2)   Contains the smallest population, as “population” is defined in I.C. 1-1-4-5.

   (E)   Areas in more than one district. If any part of the city is included in more than one of the districts established by division (C) above, then that territory is included within the district which:
      (1)   Is one of the districts in which the territory is described in division (C) above;
      (2)   Is contiguous to that territory; and
      (3)   Contains the smallest population, as “population” is defined in I.C. 1-1-4-5.

   (F)   Adoption of map.
      (1)   The Council adopts a map depicting the districts established under division (C) above and incorporates said map by reference into this division (F). Two copies of this map are on file in the office of the Clerk-Treasurer for public inspection as required by I.C. 36-1-5-4.
      (2)   If a conflict exists between the districts as depicted on the map and as described in division (C) above, then the description in division (C) prevails.

   (G)   County Election Board notification. The Clerk-Treasurer of the city forwarded a signed copy of this section to the Circuit Court Clerk of the county and requested the Clerk to include the copy of this section in the records of the County Election Board.
