(A) Accidental discharge. Users shall notify the Agency immediately upon accidentally discharging wastes in violation of this chapter. Within five days of the date of occurrence, this notification shall be followed by a detailed written statement describing the causes of the accident and the measures being taken to prevent reoccurrences. Such notification will not relieve a user of liability for any expense, loss or damage to the sewer system, treatment plant or treatment process, or for any fines imposed by the Agency in accordance with this chapter.
(B) Notification of employees by user.
(1) Users shall make available to those employees responsible for the user’s discharge a copy of this chapter together with such other wastewater information and notices which may be furnished by the Agency from time to time.
(2) A notice shall be furnished and permanently posted on the user’s bulletin board and in the immediate vicinity of the location of equipment where discharges are possible advising employees of whom to call in case of an accidental discharge in violation of this chapter. Employees may be directed to contact a designated Agency official.
(C) Suspension of service. The Agency may immediately suspend the treatment service of a discharger if it appears to the Agency that an actual or threatened discharge presents an immediate danger to the welfare of persons, the environment or the operations of the POTW or violates any pretreatment limits or any discharge permits.
