(A) Establishment. There is hereby established a City Pool Maintenance and Capital Improvement Cumulative Fund.

(B) Purpose. The aforesaid Fund shall be administered by the City Parks Board for the purposes of maintenance, repair, equipment purchase and other capital improvements deemed necessary and proper by the Board for the purpose of ensuring the continued maintenance and operation of the City Memorial Pool and any other pools which may be established or constructed by the city in the future.

(C) Sources.
(1) The City Parks Board shall establish admission fees and user fees for any and all city swimming pools. Fifty percent of the fees so generated shall be deposited in the Fund herein established and shall be appropriated through the methods prescribed by statute and ordinance and at the times when the regular annual budget is made, as well as at times when additional appropriation is deemed necessary and requested by the City Parks Board. The funds are to be deposited at interest by the Clerk- Treasurer and may accumulate indefinitely if not appropriated and used from year to year.
(2) The funds shall be used solely and exclusively for the purpose herein defined and for no other purpose.

(D) Emergency appropriation purposes. The Fund herein established may be also used, with approval by ordinance of the Common Council, for emergency appropriation purposes, with the usual budget publication provisions and other restrictions at the time as the Parks Board recommends the appropriation and the Common Council approves the appropriation by ordinance.

(E) Depositing of funds. The Clerk-Treasurer is to deposit funds accumulated in the Fund herein established at interest at a time when it is feasible and proper to do so and still maintain the ability to meet claims against the Fund.

(F) Other fees generated. The remaining 50% of fees generated by admissions to any pool operated under the jurisdiction of the Parks Board shall continue to be deposited in the General Fund with the objective of defraying and offsetting the costs of the General Fund through budgets established at maintaining and operating the pool and public park system.

(G) Effective date and continuance of operation. This section and the Fund took effect on an emergency basis immediately upon establishment by ordinance by the Common Council of the city and continued in operation for a minimum of five years, and shall continues in operation until calender year 1993 and thereafter unless repealed by a two-thirds vote of the Common Council of the city.
