§ 35.24 BUILDING INSPECTION AND CODE ENFORCEMENT FUND.
   (A)   There is hereby established the Building Inspection and Code Enforcement Fund, wherein the Clerk-Treasurer is authorized and required to deposit all inspection fees charged and collected and all penalties assessed and paid to the city in the course of enforcement and administration of the aforesaid codes.
   (B)   The Clerk-Treasurer is hereby authorized and required to pay from the funds deposited and accumulated within the Building Inspection and Code Enforcement Fund hereby established all charges, costs and fees owing to the inspector or inspectors conducting the inspections under the aforesaid codes and any administrative costs and incidental expenses accruing to inspections and enforcements of the aforesaid codes and to travel and transportation.
   (C)   The Clerk-Treasurer is authorized and may pay the costs of expert opinions required in enforcement of the codes, consulting fees and legal services accruing to enforcement on the condition and prerequisite that no claims are pending or anticipated which fall within the definitions of required payments as stated in division (B) above.
   (D)   Any and all expenditures authorized or required by this section are so authorized, required and enabled without any additional appropriation of funds approved by the Common Council and without adoption of any itemized budget for said hereby established Fund.
   (E)   The Clerk-Treasurer shall require all claimants to maintain proper records and submit claims required by law and the Board of Public Works and Safety, and shall maintain detailed records of receipts into the Fund herein established and the expenditures therefrom.
