6-3-2: GRADES AND SPECIFICATIONS:
All sidewalks built or ordered to be built within the city shall be built and constructed upon the grades heretofore or hereafter established; provided, however, that the city council may order sidewalks to conform to the surface of the ground where the streets have not been graded, and provided further that such order shall not establish the grade of such sidewalk nor shall the city be liable for any damage thereto by reason of the grading of any streets where such temporary sidewalks have been constructed in accordance with this section. All sidewalks constructed hereafter in any residential district shall be forty inches (40") in width and constructed integral with or abutting the curb if then constructed or then being constructed. If the curb is not then constructed, the sidewalk shall be laid to what will be the inside line of the curb when constructed. (1983 Code § 12.12.110; amd. 2004 Code)
