4-2-3: CURFEW FOR MINORS:
   A.   Curfew Designated: It is unlawful for any person under the age of sixteen (16) years or compulsory school age to be upon, loiter or stroll upon the streets, alleys, avenues, parks or other public places in the city, after the hour of ten o'clock (10:00) P.M. and before the hour of five o'clock (5:00) A.M., unless such person shall be accompanied by a parent, legal guardian or other adult person lawfully and properly accompanying said minor person; provided, that the curfew shall be extended to eleven o'clock (11:00) P.M. and before the hour of five o'clock (5:00) A.M. on any night designated by school officials as an "activity night", by notification to the police authorities by the school officials.    B.   Parental Responsibility: It is unlawful for any parent, legal guardian or any other adult person having the legal care and custody of any minor person under the age of sixteen (16) years, to allow or permit any such person to go upon, or be upon any street, alley, park or in any public place in the city after the hour of ten o'clock (10:00) P.M. and before the hour of five o'clock (5:00) A.M., without being accompanied by the parent, legal guardian or other adult person.    C.   Violators Taken Into Custody; Parents Notified: Any police officer or other law enforcement officer is authorized and empowered to take charge of any person under the age of sixteen (16) years violating the provisions of this section, and it shall be the duty of such officers to take such person to the police or city hall, and notify immediately the parent, guardian or adult person having the care and custody of such minor of the violation of the terms of this section and to inform the said person that the minor will be held at the police or city hall until called for by such parent, guardian or legal custodian.    D.   Failure To Take Charge Of Minor: It is unlawful and shall be considered a separate offense under this section for any parent, guardian, or other adult person having the legal care and custody of any person under the age of sixteen (16) years to refuse to come immediately, upon being notified to do so by the police, to the police or city hall and take charge of such minor.
