347.04 MOTOR TRANSPORTATION COMPANY VIOLATIONS.
   (a)   No motor transportation company, officer, agency, or employee of a motor transportation company, or other corporation, company, association, joint stock association, person, firm, or co-partnership, shall violate or procure, aid, or abet the violation of Ohio R.C. 4921.02 to 4921.32, inclusive, or fail to comply with any order, decision, rule, or regulation of the Public Utilities Commission of Ohio, or procure, aid or abet any motor transportation company in its failure to comply with such order, decision, rule, or regulation. Information of a conviction of a violation of this section shall be reported to the Commission by the clerk of the court in which such conviction was obtained or, if there is no clerk, by the presiding officer of the court. Such report shall be made a part of the records of the Commission relating to such private motor carrier. (1993 Code 70.40)
   (b)   Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
