(a) Dispensaries shall be operated within a secured stand-alone building and may be located only in the B Business District within a 1500 foot radius of an Interstate 74 highway exit intersection. No person shall operate a Dispensary except in accordance with a Marijuana Controlled Operation Agreement and otherwise in accordance with the restrictions contained in this Chapter 1173 and all applicable State Regulations. For the purpose of this Section, "exit intersection" shall be the centerline of the exit ramp off of Interstate 74 and the adjoining public right of way.
(b) No Dispensary may be established or operated within 500 feet of a school, church, public library, public playground, public park, residential lot (as defined in the City of Harrison Zoning Code), or senior assistant living facility in the City.
(c) No Dispensary may be established, operated, or enlarged within 500 feet of another Marijuana Business.
(d) Not more than one Dispensary shall be established or Operated in the same building, structure, or portion thereof, and the floor area of any Dispensary in any building, structure, or portion thereof containing another Dispensary may not be increased.
(e) For the purpose of subsections (b) and (c) of this section, measurement shall be made from the nearest portion of the building or structure used as the part of the premises where a Dispensary is conducted, to the nearest property line of the premises of a Dispensary, Marijuana Business or a school, church, public library, public playground, public park, residential lot, or senior assistant living facility.
