521.11 SMOKING PROHIBITED IN CERTAIN PUBLIC PLACES.
   (a)   Definitions.
      (1)   "Public place" means an area to which the public is invited or in which the public is permitted and that is not a private residence and which is owned or maintained by the City of Harrison.
      (2)   "Roofed Structure" shall only include a structure located in a public place, as defined herein, which has a roof but which may or may not be enclosed by walls.
      (3)   "Smoke or Smoking" means inhaling, exhaling, burning, or carrying any lighted cigar, cigarette, pipe, weed, plant, or other combustible substance or smoking equipment in any manner or in any form. "Smoking" does not include the burning or carrying of incense in a religious ceremony.
   (b)   Smoking Prohibited. In addition to any other location prohibited by law, no person shall smoke in any roofed structure in the City of Harrison.
   (c)   Signage Required. The City shall place, in any roofed structure covered by this Ordinance, signs indicating that smoking is prohibited. Signs shall comply with the requirements of Ohio R.C. 3794.06. If the international "No Smoking" symbol (consisting of a pictorial representation of a burning cigarette enclosed in a red circle with a red bar across it) is to be used, it must be in color.
   (d)   Penalty. Whoever violates any provision of this Section is guilty of the offense of smoking in prohibited places. Such offense is a minor misdemeanor, punishable by a maximum fine of $150.00. (Ord. 16-17. Passed 7-18-17.)
