1502.05 DE MINIMIS VIOLATIONS.
    (a)   When a City of Harrison fire code official finds that a violation of the Harrison fire code is a de minimis violation, the fire code official may prepare a written notice of violation, in lieu of issuing a citation.
   (b)   The written notice of violation should:
      (1)   Be in writing;   
      (2)   Identify the specific violation;
      (3)   Include a statement of the reason or reasons the notice is being issued and refer to the sections in the Fire Code that is being violated;
      (4)   State the time by which the violation shall be corrected; and
      (5)   Be served in one of the following methods:
         A.   By personal delivery to the person or persons responsible for the violations and/or property or by leaving the notice at the usual place of residence of the owner with a person of suitable age and discretion.
         B.   By certified mail deposited in the U.S. Post Office addressed to the person or persons responsible at his or her last known address. If a certified mail envelope is returned with endorsement showing that the envelope is unclaimed, then service shall be sent by ordinary mail and the mailing shall be evidenced by a certificate of mailing which shall be filed by the fire chief or his or her authorized representative. Service shall be deemed complete when the fact of the mailing is entered as a matter of record provided that the ordinary mail envelope is not returned by the postal authorities with an endorsement showing failure of delivery.
         C.   By posting a copy of the notice form in a conspicuous place on the premises found in violation.
   (c)   If, after a person is given notice of a fire code violation, the violation is not remedied in the specified amount of time, the fire code official may issue a citation to the person responsible for the property or the violation and the fire code official may request the law director of the City of Harrison to institute the appropriate legal proceedings in order to correct or abate the violation.
   (d)   Each day the violation continues after receipt of a citation, shall be considered a separate offense. (Ord. 20-12. Passed 9-4-12.)
