(a) Any internet sweepstakes café shall have at least one owner , operator or employee who is twenty one years or older on the premises during operating hours.
(b) The operator of any internet sweepstakes café must require photo identification of every person to whom anything of value is given in connection with the internet sweepstakes café and shall record the person's name, date of birth, and home address along with a description of the thing given, a stated dollar value, the date and time, and if a computerized sweepstakes device is involved, the serial number or other identifying description of the device. If the dollar value is Six Hundred Dollars ($600.00) or more, the operator shall also include in the record a copy of the photo identification along with the person's social security number. By the second Tuesday of each month the operator shall cause to be delivered to the Chief of Police a copy of the record containing the information set forth above for the preceding month. Except as required by this Section, no person shall disclose the social security number provided accept as required by law.
(c) Any internet sweepstakes café which is granted a permit to operate pursuant to this Section must permit any adult member of the public to participate in at least one sweepstakes per person per (sweepstakes/day/week/month) without requiring the contemporaneous or additional purchase of any good or service provided by the café operator.
(d) The owner or operator of an internet sweepstakes device shall post, in a conspicuous location and in the same room as any computerized sweepstakes device is operated, the following in no less than twenty point font:
(1) Each separate prize that may be given and the dollar amount or value thereof.
(2) The odds of winning any potential prize consistent with the information provided in the permit application pursuant to Section 761.03.
(3) A complete statement of the rules and conditions pertaining to the giving of any prizes or anything of value to any person, whether or not the determination of giving of the thing of value or the delivery of the thing of value occurs totally within the confines of the premises or requires some event, occurrence or happening at another location. Patrons must also be informed of the rules governing participation in the sweepstakes without making any contemporaneous or additional purchase of goods or services from the operator.
(e) The operator shall keep a complete set of all records of the operations at the premises at all times, including federal, state and local tax records, all records of payments and receipts, all records of expenses and revenues of the operation, all banking records, all contracts, leases and agreements affecting the premises, equipment and operation, and all personnel records. The operator shall also record the number of free sweepstakes entries provided on a monthly basis.
(f) Operators are strictly liable for violations of this Chapter.
(g) No person shall be denied a permit pursuant to this Chapter or be denied the ability to use a licensed computerized sweepstakes device on the basis of race, gender, religion or national origin.
(h) The operator shall register any additional computerized sweepstakes device which the owner installs or operates at the premises. Such additional devices shall not exceed the total number of devices permitted at any one location pursuant to Section 761.03. Failure to register a device in accordance with this Section or permitting a device in excess of the total allowable number of device to be operated shall constitute an unclassified misdemeanor subject to a penalty of one hundred fifty dollars ($150.00) per occurrence. Each day that a device remains operational and unregistered or in excess of the total number of allowable devices shall constitute a separate occurrence. (Ord. 18-12. Passed 8-21-12.)
