127.03 COLLECTION PROCEEDINGS TO RECOVER COST OF INCARCERATION.
   Council hereby determines that individuals who are incarcerated in the Hamilton County Jail shall reimburse the City, pursuant to the provisions of Ohio R.C. 753.02 and 753.04, for all of the expenses incurred by reason of the confinement of the individual, including, but not limited to, the expense relating to the provision of food, clothing and shelter. The amount of reimbursement shall be determined by a court pursuant to the provisions of Ohio R.C. 2929.18 whereby the municipal court, County Court, or Mayor, or Mayor’s Court shall impose a financial sanction which requires the offender to reimburse the City for the cost of the confinement. All funds reimbursed pursuant to this section shall be deposited into a special revenue fund, which shall be known as the “Confinement Reimbursement Fund” that shall be established by the Harrison Auditor pursuant to the approval of the State of Ohio Auditor. This special fund shall be utilized in order the pay the costs incurred by the City for such incarceration or for operating the City’s temporary holding facility. A determination of the financial sanction imposed pursuant to this section shall represent a judgment in favor of the City, and the City may proceed with execution of the judgment, including attachment, proceedings in aid of execution, a wage or other asset garnishment, or any other proceeding provided in order to aid a judgment creditor in executing upon the judgment.
