(a) Permit; Security Deposit Required. Organizations or groups wishing to use community or City lands for public or private functions must apply for a permit.
(1) Applications can be picked up at the Police Station and must be returned at least ten days prior to the event.
(2) Five working days after the applicant submits the application, he may return to pick up his signed copy of the permit.
(3) A $25.00 security deposit is required with the application for the permit. The security deposit shall be returned three working days after the date of the event if no damage or clean-up fee is assessed. If damage or clean-up costs exceed the $25.00 deposit, the permit holder shall be responsible for the difference and the deposit shall be forfeited.
(4) At least one legally responsible adult must sign the application for permit and accept responsibility for the group or organization.
(b) Prohibitions.
(1) The use of the park and permit are cancelled at darkness unless the permit states otherwise.
(2) Code provisions and other ordinances of the City that regulate noise, profanity and disorderly conduct shall be observed by all persons included under the permit.
(3) The use of alcoholic beverages is prohibited unless the group or organization has obtained a liquor permit for the scheduled activity. A copy of the liquor permit must be filed with the application set forth in division (a) of this section. Police security must be supplied by the applicant.
(4) No nails, spikes, staples, tacks or signs may be affixed or driven into any fixed structure or trees on public land.
(5) Fires or open-burning are prohibited. This does not include facilities designated and supplied with outdoor grilling equipment.
(6) Grass, shrubs, trees and other living plants must be returned to the condition prior to the event or activity, otherwise they must be replaced.
(7) No structure in the park shall be damaged, defaced or removed from the park.
(8) No structure shall be erected within four feet of the base of a tree or shrub.
(9) The area must be completely cleaned at the close of the activity. Failure to do so may result in a loss of the security deposit.
(c) Violations. Any violation of the rules, conditions and guidelines that are violated by any member of the organization or group shall cause the permit to be immediately revoked and subsequent requests may also be denied.
(d) Parks and Recreation Commission Exempt. These rules, conditions and guidelines do not apply to any activity scheduled or sponsored by the Parks and Recreation Commission. (1993 Code 100.02)
