§ 95.071 FIRE PREVENTION BUREAU: ESTABLISHMENT AND DUTIES.
   The North Carolina Fire Code of the State Building Code shall be enforced by the Fire Department Fire Prevention Bureau in the Fire Department of the town, which is hereby established and which shall be operated under the supervision of the Chief of the Fire Prevention Bureau or the Fire Marshal.
   (A)   Service of order. The service of an order to remedy a defect may be made upon the occupant of the premises, either by delivering a copy of the order to the occupant personally or by delivering the same to any person in charge of the premises or, in case no person is found upon the premises, by affixing a copy of the order in a conspicuous place to the entrance of the premises. If the owner of the premises is some person other than the occupant thereof, service of notice may be made by delivering a copy of it to the owner personally or by mailing the copy to his or her last known address. If the occupant or owner is a partnership, service upon any partner shall be sufficient or, if a corporation, upon any official or local agent thereof.
   (B)   Failure to comply with order unlawful. It shall be unlawful to fail to comply within a reasonable time after the service of such order with the requirements thereof.
   (C)   Right to enter a building or premises. The Chief of the Fire Department, or any member of the Fire Department when so directed by the Chief of the Fire Department, shall have the right to enter any building or premises at any reasonable hour for the purpose of making any inspection provided for by this chapter.
