No person shall maintain, erect, or permit the erection of any temporary or permanent building, hut, hotel, shanty, tent, basketball goal, culvert, or other structure under his or her control upon any street, sidewalk, alley, or other public way or right-of-way within and under the control of the town and open to public use, without the express consent of the town. A violation of this section is punishable as a misdemeanor.
