§ 53.040 GENERAL STANDARDS.
   (A)   All development and redevelopment to which this chapter applies shall comply with the standards of this section.
   (B)    Projects shall be considered low density if it contains no more than 24% built- upon area or no more than two dwelling units per acre; otherwise, it shall be considered high density. The following requirements shall apply to the calculation of project density:
      (1)   Project density shall be calculated as the total built-upon area divided by the total project area.
      (2)   A project with existing development may use the calculation method in Sub-301(A) or shall have the option of calculating project density as the difference of total built- upon area minus existing built- upon area divided by the difference of total project area minus existing built-upon area.
   (C)   SCMs shall be designed, constructed and maintained so that the project achieves either runoff treatment or runoff volume match. For high density projects designed to achieve runoff treatment, the required storm depth shall be one inch.
   (D)   Storm water runoff from the development shall be transported from the development by vegetated conveyances to the maximum extent practicable.
   (E)   Post-development discharges from development shall minimize downstream private and public property damage resulting from flooding and impact to the performance of public infrastructure.
   (F)   The approval of the storm water permit shall require an enforceable restriction on property usage that runs with the land, such as recorded deed restrictions or protective covenants, to ensure that future development maintains the site consistent with the approved plans.
   (G)   All development to which this chapter applies shall comply with the standards set forth in § 15 of Article 4 of the town's Unified Development Ordinance, titled River/Stream Overlay (RSOD) District and pertaining to the preservation of natural vegetated or re-vegetated areas along designated streams and rivers. Approval of a storm water plan shall be granted on adherence of the standards of § 4.15 of the town's Unified Development Ordinance. New storm water outfalls resulting from development authorized under this chapter shall be constructed to discharge their storm water as sheet flow prior to entering the riparian buffer.
   (H)   All development to which this chapter applies shall comply with the soil erosion and sedimentation control standards, where applicable, and administered by North Carolina Department of Environmental Quality.. A storm water permit shall be granted to the development once the development has received an approved erosion control permit and registered a copy of the permit and plan with the Storm Water Administer.
   (I)   All development shall comply with the town's zero net fill requirement. Net fill shall not be permitted on any lot or parcel of property, or any part thereof, located within a critical drainage area or within the 100-year floodplain as designated on the most current FEMA floodplain map, without express written consent of the Engineering and Public Works Director or his or her designee.
