17-401: DEFINITIONS:
The following words, terms and phrases when used in this code shall have the meaning ascribed to them in this section, except where the context clearly indicates a different meaning:
BUSINESS, COMMERCIAL ESTABLISHMENT OR INSTITUTION: Includes any building or structure or premises not defined as a residence.
COLLECTIBLE SOLID WASTE: All solid waste including, but not limited to, garbage or trash except noncollectible or hazardous waste.
GARBAGE: All putrescible waste from any place where meats, fish, fowls, fruits, or vegetables are prepared for food for consumption and shall include all household waste including organic matter that has been prepared for or was intended to be used as food or has resulted from the preparation of food.
HAZARDOUS WASTE: Materials or substances which by reason of their compensation or characteristics are: a) hazardous waste as defined in the solid waste disposable act, 42 USC section 691 et seq., or the regulations thereunder, or the Oklahoma hazardous waste disposable act, 63 Oklahoma Statutes section 1-2001 et seq., or the regulations thereunder, in any similar or substituted legislation or regulation or amendments to the foregoing; b) any other material which any governmental agency or unit having appropriate jurisdiction shall determine from time to time are harmful, toxic or dangerous.
MULTI-FAMILY DWELLING UNITS: Apartments, condominiums, rooming houses, boarding houses or any other dwelling unit intended for occupancy by more than one family.
MUNICIPAL SOLID WASTE: Collectible solid waste.
NONCOLLECTIBLE WASTE: Includes pathological and hospital waste, poisons, acids, caustics, explosives, body wastes, automobile frames, crank cases, transmissions, large truck tires, large bulky objects such as stoves, refrigerators, furniture, trees and materials that may cause damage to collection equipment or personal injury to collectors, dirt, rocks, or debris resulting from construction, reconstruction or repairs of buildings, animal excreta, or any article of substance soil by human or animal excreta that has not been wrapped and tightly sealed in moisture proof paper prior to placement for collection, and refuse which has been combined or mixed with any of the above mentioned items, sewage, liquid waste and other highly diluted water carried materials or substances and those in gaseous form, special nuclear material or byproducts and materials, as defined in the atomic energy act of 1954, as amended, or hazardous waste.
OCCUPANT OF PREMISES: The occupant of any premises within the city.
OWNER: The owner of all premises where more than one family resides on a lot, a parcel of land, or adjoining lots or parcels of land belonging to the same person, unless the premises occupied by each family, including the yards, are clearly defined and under the exclusive control of the occupant.
PREMISES: Land, buildings, or other structures or parts thereof, or in which refuse is stored or accumulated.
REFUSE: All putrescible and nonputrescible solid waste including garbage, rubbish and trash.
RESIDENCE: Any building or structure used solely as a family domicile including single-family or multi-family dwelling units, duplexes, triplexes, and trailer courts, but shall not include hotels, tourist courts, motels, motor courts, motor hotels, or apartment hotels.
RUBBISH: A normal accumulation by resident families or commercial establishments of worthless or offensive matter, the accumulation of which may create a nuisance or be deleterious to public health or offensive to sight or smell.
TRASH: Nonputrescible solid waste, including excessive accumulations of household rubbish, but shall not include waste matter that is not in a proper container or is not specified in this chapter.
UNDER ACCUMULATION: The accumulation of garbage, rubbish or trash in amounts exceeding the capacity of the waste receptacle at the pick up point or at the point of disposal. (Ord. 2004-8, 8-5-2004)
