9-301: PERMITS REQUIRED FOR CONDUCTING PRIVATE SALES, DANCES, CIRCUSES, OR CARNIVALS:
   A.   A permit, setting forth the specific date for which it shall be valid, shall be obtained from the city clerk to conduct a dance, rummage sale, garage sale, yard sale, circus or carnival and any person, firm, or corporation so applying shall pay a fee as follows:
 
1. Circus or carnival for a period of 7 consecutive days

2. Rummage, garage or yard sale pursuant to provisions of this section

   B.   It is further provided that any nonprofit charitable organization may obtain a permit as set out without the payment of the fee set out in subsection A of this section.
   C.   "Residential sale" shall mean any sale held out to be or commonly known as garage, room, porch, yard or any other type of general sale conducted from or on any premises not located in zoning district which permits such sales.
   D.   It is unlawful for any person to hold, conduct, engage in or allow a residential sale to be held or conducted on premises under his control or ownership more often than every three (3) months, and in no event shall the total number of such sales exceed four (4) in any twelve (12) month period.
   E.   A fee shall be paid to the city for each residential sale held in accordance with these regulations.
   F.   A permit will be issued to any person for a residential sale not to exceed four (4) consecutive days in compliance with this section provided the applicant is in compliance with the requirements of this chapter and other ordinances of the city.
   G.   Regulations governing signs or other advertising devices are as follows:
      1.   The maximum length of time for any residential sale shall not exceed four (4) consecutive days.
      2.   No sign shall be posted more than two (2) days prior to the sale.
      3.   Signs are to be removed by the permittee within forty eight (48) hours of the end of the residential sale.
      4.   Signs are not to be placed on utility poles, trees, culverts or bridges or any other structure being part of streets or roadway.
      5.   Signs must be dated with the dates of the sale and permit number.
   H.   If for any reason the applicant is unable to hold sale as scheduled, the permit may be voided or changed if returned to the city hall by twelve o'clock (12:00) noon on the first day of the scheduled sale. If the sale is to begin on a Saturday or Sunday, the permit must be returned by five o'clock (5:00) P.M. the preceding Friday.
