(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
(B) (1) Violation. Any non-compliance with conditions of a county permit or operation of a facility without a permit, any release of hazardous or low-level radioactive waste in amounts sufficient to constitute a hazard to the public health and safety, any non-compliance with the procedural requirements of §§ 91.01 through 91.13 or refusal to permit county officials designated under §§ 91.01 through 91.13 to enter buildings, structures, enclosed areas, or other areas in the performance of their lawful duties, any refusal to pay taxes and fees as provided for by §§ 91.01 through 91.13, and any failure to provide information or apply for amendment to permit(s) as may be required by §§ 91.01 through 91.13 upon proper notice shall be a misdemeanor, which may be punished as indicated in G.S. Chapter 14.
(2) Every day a separate violation. Each day of violation of §§ 91.01 through 91.13 shall constitute a separate offense.
(3) Injunctions. The county may seek injunctions in any court of competent jurisdiction, when the operation of a hazardous or low-level radioactive waste facility is, in the judgment of the Health Department, creating an imminent hazard to the health, safety, and welfare of the public. The county may also seek any other appropriate legal or equitable relief that it deems necessary or appropriate to ensure the public health and welfare.
