10-3-8: PENALTIES:
   A.   Civil Penalties: The following scale of increasing civil fines for violation of this chapter shall be as enforced as follows:
First offense
Written warning
Second offense
$10.00 fine
Third offense
20.00 fine
Fourth offense
30.00 fine
Fifth or subsequent offense
50.00 fine
If civil fines are not paid within ten (10) days of the issuance of the civil citation, the City Finance Officer may charge a late fee of one hundred percent (100%) of the fine owed.
There shall be a lookback period of one year. If a vehicle or owner has not had a civil citation for parking violation in the City of Hardin for one year or more, then the citation shall be issued as a first offense. However, if there has been a previous civil citation within one year, all previous citations may be counted for the five (5) previous years. The lookback period does not extinguish any fines or late fees that may be owed or due to the City Finance Officer. The one year lookback period does not apply if previous civil citations for parking have not been paid.
The City Finance Officer, with advice of the City Attorney, may review citations upon the owner or driver's written application to contest the civil citation. Written applications to contest civil citations must outline the nature of the contest and must be received within ten (10) days of the issuance of the civil citation. Upon receipt of the written application to contest, the City Finance Officer will review said application to contest and the civil citation and issue a ruling within thirty (30) days of receipt of the application. Late fees will be tolled during this review.
   B.   Criminal Penalty: It shall be a criminal misdemeanor to have five (5) or more unpaid civil citations for parking violations. If it is determined by the City Finance Officer and City Code Enforcement Officer that a vehicle or owner has five (5) or more unpaid civil citations, they shall turn over all information to the City Attorney for prosecution in the Hardin City Court. A person found guilty of a violation of this subsection shall be subject to a fine of not more than five hundred dollars ($500.00), and imprisonment of up to six (6) months in the County Jail.
