4-12-4: APPLICABILITY:
All wireless communication facilities located within the jurisdictional area of the city whether upon private or public lands shall be subject to this chapter. This chapter shall apply to wireless communication facilities upon state and federal lands to the extent of the city's jurisdiction by way of law, pursuant to any memoranda of understanding or otherwise. Only the following facilities shall be exempted from the application of this chapter:
   A.   Amateur Radio: Amateur (ham) and citizen band transmitters or radio stations, antennas, and microwave dishes and receivers, except the provisions regarding abandoned antenna support structures shall apply to amateur (ham) and citizen band transmitters or radio stations, antennas, and microwave dishes and receivers.
   B.   Emergency Communication Facilities: Temporary communication facilities for emergency communications by public officials.
   C.   Preexisting Antenna Support Structures Or Antennas: Preexisting antenna support structures and preexisting antennas shall not be required to meet the requirements of this chapter, so long as said preexisting antenna support structures have received all required approvals, permits, and exceptions prior to adoption of this chapter.
