7-2-3: DEFINITIONS:
For the purpose of this chapter, the following terms shall have the meanings ascribed to them in this section:
HAZARDOUS TREES: Public or private trees in a condition (dead, damaged, diseased or dying) by which they are a hazard or a future hazard to the public and/or public or personal property.
OBSTRUCTIVE TREES: Public or private trees that prevent appropriate passage or safe vision on any public rights of way.
PARK TREES: Trees or shrubs in public parks or open spaces owned by the city to which the public has free access.
PRIVATE TREES: All other than public trees and shrubs.
PUBLIC RIGHT OF WAY: Improved or unimproved public property owned by, dedicated to, or deeded to the city for public, pedestrian, vehicular or other use. It includes, but is not limited to, streets, alleys, sidewalks, access routes for public utilities and open public spaces such as parks and city landscaping.
PUBLIC TREES: Trees or shrubs situated in such a manner that over fifty percent (50%) of the base, trunk or canopy is on public property or impacting the public right of way.
STREET TREES: Trees or shrubs on land lying between property lines on all public rights of way within the city. (Ord. 188, 4-13-2009)
