7-1-3: SALE OR DISPLAY OF MERCHANDISE:
   A.   Compliance With Section: It is unlawful for any person or business entity to offer to sell or to consummate sales or to display merchandise or to conduct demonstrations of merchandise on or within the boundaries of any public right of way except as provided in this section.
   B.   Grant Of Permission: The city may grant prior permission for such conduct. In granting permission, the city shall consider, among other things, the length, nature, time and place of the event and shall satisfy itself that the public welfare will be adequately secured.
   C.   Requirements Of Applicant: The city shall require the applicant to provide adequate security, holding and saving the city harmless from any injury caused any person or property due to the applicant's conduct; shall instruct the applicant to avoid the complete blockade of any portion of the public right of way utilized; and shall require the applicant to be singularly and solely responsible for the cleaning of the entire public right of way surrounding the event for which permission is given.
   D.   Filing Application Prior To Event: A person is required to apply to the city for the permission provided for at least thirty (30) days prior to the intended event. Permission granted by the city shall be by letter, setting forth all of the conditions of the permission given and shall be signed by the applicant.
   E.   Appeal City Decision: Any person aggrieved by the decision of the city or any of the conditions imposed by the city in granting such permission may appeal to the city council by orally informing the city of such intent. The appeal shall be heard at the next regularly scheduled city council meeting. (1991 Code § 12.04.050)
