ORDINANCE NO.  223
AN ORDINANCE OF THE CITY OF HANSEN, IDAHO; CHANGING THE ZONING CLASSIFICATION OF REAL PROPERTY DESCRIBED HEREIN FROM COMMERCIAL TO R-2 RESIDENTIAL DISTRICT; AMENDING THE ZONING MAP OF THE CITY OF HANSEN TO REFLECT SAID CHANGE; PROVIDING FOR A REPEALER CLAUSE; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE UPON PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW.
WHEREAS, the Hansen City Council, pursuant to public notice as required by law, held a public hearing on January 11, 2021, on the proposed re-zone application for real property more particularly described as HANSEN TAX NUMBERS, TAX #830, EXC E 87' OF N 195',, EXC SE 135.71' & EXC W 130' IN, NW NW, (25-10-18), and located at 133 Highway 30 West, Hansen, Idaho, parcel no. RPH93310246120 as required by Idaho Code Section 67-6511, made findings and determined that said real property be rezoned from Commercial to R-2 Residential District and that the Zoning District Map of the City of Hansen be amended to reflect said change.
 
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF HANSEN, IDAHO:
 
SECTION 1.  The Hansen City Council hereby finds and declares that the real property more particularly described as HANSEN TAX NUMBERS, TAX #830, EXC E 87' OF N 195', EXC SE 135.71' & EXC W 130' IN, NW NW, (25-10-18), and located at 133 Highway 30 West, Hansen, Idaho, parcel no. RPH93310246120 (“Subject Real Property”), be rezoned from Commercial to R-2 Residential District in accordance with the Hansen zoning ordinance regulations, Title 10, Chapter 4B, R-2 Residential District.
 
SECTION 2.  The City Council hereby finds and determines that the Subject Real Property be removed from the Commercial zoning classification and included in R-2 Residential District zoning classification pursuant to the Zoning Ordinance of the City of Hansen. The City Council further finds and determines that said zone change is in accordance with the Hansen Comprehensive Plan and relevant City Codes.
 
SECTION 3The Zoning District Map of the City of Hansen, Idaho, is hereby amended to reflect the foregoing change in zoning classification.
 
SECTION 4. Repealer Clause.  All Ordinances and Resolutions or parts thereof in conflict herewith are hereby repealed and rescinded.
 
SECTION 5. Severability Clause.  If any section or portion of this ordinance is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance.
 
SECTION 6Effective Date.  This Ordinance shall take effect and be in force from and after its passage, approval, and publication as required by law.
