§ 33.999 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   A person who smokes in an area where smoking is prohibited by the provisions of §§ 33.035 to 33.041 shall be guilty of an infraction, punishable by a fine of $50.
      (2)   (a)   A person who owns, manages, operates, or otherwise controls a public place and who fails to comply with the provisions of §§ 33.035 to 33.041 shall be guilty of an infraction, punishable by:
            1.   A fine of $100 for a first violation;
            2.   A fine of $200 for a second violation within one year; and
            3.   A fine of $500 for each additional violation within one year.
         (b)   Each day on which a violation of §§ 33.035 to 33.041 occurs shall be considered a separate and distinct violation.
