§ 31.08 CABLE ADVISORY BOARD.
   (A)   Members; terms.
      (1)   Members. There is hereby established a Cable Advisory Board with two members appointed to that Board from each local governmental unit. Members appointed to the Board shall be residents of the geographic area of the local government unit making that appointment, and shall serve at the pleasure of the local government unit. Members of the Board shall serve without compensation, but shall be entitled to reimbursement of expenses from the Cable Advisory Board Fund at the same rate as applies to city employees.
      (2)   Terms. The standard term of each appointment shall run from January 1 through December 31 for a period of three years.
         (a)   The terms of each appointee shall be staggered so that no more than one appointee from each government unit shall have his or her term expire at the end of any one year.
         (b)   No individual shall be appointed for more than two consecutive full terms.
         (c)   An appointee who is named to replace a Board member shall be expected to complete the remaining portion of the departing Board member’s term.
   (B)   Contributions.
      (1)   The Board shall be funded by contributions from the cable franchisee, any appropriations from the local governmental units, and is authorized to receive gifts and other contributions from any other source.
      (2)   Any funds of the Board, from any source, shall be deposited with the City Clerk- Treasurer,
who shall receive, disburse, and account for all monies of the Board pursuant to I.C. 36-1-7-4(a)(3).
         (a)   A committee of three Board members who are not officers and represent each of the governmental units shall conduct an annual audit and submit the results of that audit to the City of Madison Clerk-Treasurer by March 1.
         (b)   Claims for expenses of the Board shall be approved by a plurality of the Board at a public meeting and shall be paid by the Treasurer of the Board.
      (3)   The Cable Advisory Board shall be authorized to use the tax exempt number of the City of Madison.
   (C)   Duties.
      (1)   The Cable Advisory Board shall execute its duties according to terms described in the Cable Television Franchise Agreement.
      (2)   The Board shall advise the local governmental units on issues involving cable television and the Cable Franchisee Agreement.
      (3)   The Cable Advisory Board shall coordinate use of local access programming channels with the cable operator.
         (a)   The duration of the interlocal agreement shall be for the same period as the Cable Television Franchisee Agreement.
         (b)   Upon termination of the interlocal agreement, any property of the Cable Advisory Board shall become the property of the local governmental units. If a governmental unit chooses to terminate its participation in this agreement prior to the termination of this agreement by all other participating governmental units, that governmental unit forfeits any and all claim to any property of the Cable Advisory Board.
