§ 31.07 DEPARTMENT OF PARKS AND RECREATION.
   (A)   Under the provisions of I.C. 36-10-5-2(b)(1), there is hereby created a municipal Department of Parks and Recreation;
   (B)   The Hanover Parks Board is hereby organized and structured with the membership of a park authority under I.C. 36-10-5-2(b)(1). Accordingly, the members of the municipal legislative body of Hanover shall hereafter serve as ex officio members of the Hanover Parks Board.
   (C)   The Hanover Parks Board shall have all authority and responsibility over the operating and maintenance of the Hanover Parks Department, including but not limited to, all property, facilities, personnel, and rules and regulations of the Hanover Parks Department, as may be permitted by Indiana law:
   (D)   The Hanover Parks Board shall have the power to perform all acts necessary to acquire and develop sites and facilities and to conduct such programs as are generally understood to be park and recreation functions; in addition, the Board shall have all the powers listed in I.C. 36-10-3 et seq.
   (E)   The Hanover Parks Board may, from time to time, establish advisory committees interested in the town, public parks, playgrounds, recreational facilities, programs and properties, having authority and responsibility as directed by the Hanover Parks Board.
   (F)   The Town Council may appoint a Superintendent of Parks and Recreation to perform such duties as may be determined necessary for the efficient management of parks and recreational areas and facilities that may be under the jurisdiction of the town.
   (G)   The Superintendent of Parks and Recreation shall be selected by the President of the Town Council and subject to the approval of the members of the Council. Such Superintendent shall serve at the pleasure of the Council and be compensated at an amount determined appropriate for the scope of the duties to be performed.
   (H)   The Superintendent may have such powers, duties and responsibilities as are provided by I.C. 36-10-3 et seq.
   (I)   It shall be the responsibility of the Superintendent to make a thorough and comprehensive study of the future of the park and recreation needs of the town and its environs and to make such recommendations to the Town Council each calendar year as the Superintendent may deem necessary in addition to the other duties as may be established by the Council.
   (J)   The Hanover Parks Board shall prepare and submit an annual budget in the same manner as other departments of town government as prescribed by the State Board of Accounts. The Hanover Parks Board may accept gifts, donations, and subsidies for park and recreation purposes.
