(A) All construction projects shall have and implement erosion/sedimentation control plans.
(B) All construction within a floodplain shall be reviewed and permitted by the Town Building Inspector.
(C) The following practices shall be incorporated into construction of any facilities:
(1) Discharges should not restrict or impede the movement of aquatic species indigenous to the waters or the passage of normal or expected flows or cause the relocation of waters (unless the primary purpose of the fill is to impound waters);
(2) Minimize the adverse impacts on the aquatic system associated with the discharge of impounded waters;
(3) Avoid discharges into wetlands or breeding and nesting areas; and
(4) Place heavy equipment working in wetlands on mats.
(D) A conditional use permit shall be obtained for all excavation and filling operations. Such permit shall require approval from the Town Council and the town’s Planning Commission, with review and comment by the Soil Conservation Service. In addition, filling operations shall conform with the criteria of local and/or state public health agencies and the state’s Department of Natural Resources.
