§ 31.02 PUBLIC VIDEO SERVICE BOARD.
   (A)   There is hereby established a Public Video Service Board consisting of nine members.
      (1)   Three members are appointed to that Board from each local government unit.
      (2)   One member appointed to the Board should be a member of the local government unit making that appointment.
      (3)   Two residents shall be residents of the geographic area of the local government unit making that appointment, and one member may be a resident of the county at-large.
      (4)   All three members shall be current subscribers to video and/or high-speed internet service from a video service franchisee, and shall serve at the pleasure of the local government unit.
         (a)   The standard term of each appointment shall run from January 1 through December 31 for a period of three years.
         (b)   The terms of each appointee shall be staggered so that no more than one appointee from each government unit shall have his or her term expire at the end of any one calendar year.
         (c)   No individual shall be appointed for more than two consecutive full terms.
         (d)   An appointee who is named to replace a Board member shall be expected to complete the remaining portion of the departing member’s term.
   (B)   The Public Video Service Board shall be funded by contributions from video service franchisees, any appropriations from the local governmental units, any funds collected from requested services, and is authorized to receive gifts and other contributions from any other source. Any funds of the Public Video Service Board, from any source, shall be deposited with the Madison Clerk-Treasurer, who shall receive, disburse, and account for all monies of the Public Video Service Board pursuant to I.C. 36-1-7-4(a)(3). A committee of three Public Video Service Board members, including the Treasurer, shall conduct an annual financial review and submit that the results of that review to the Board and the Madison Clerk-Treasurer by March 1.
   (C)   Claims for expenses of the Public Video Service Board shall be approved by a plurality of the Public Video Service Board at a public meeting and shall be paid by the Treasurer of the Public Video Service Board. The Public Video Service Board shall be authorized to use the tax-exempt number of the City of Madison.
   (D)   The Public Video Service Board shall execute its duties according to terms described in the video service franchise agreement. The Public Video Service Board shall oversee local access programming, shall advise the local government units on issues involving the video service franchise agreements, and issues involving public video service. The Public Video Service Board shall also coordinate use of local access programming channels with video service operators.
   (E)   Members of the Public Video Service Board shall serve without compensation, but shall be entitled to reimbursement of expenses from the Public Video Service Board Fund at the same rate as applies to city employees.
   (F)   Upon termination of this agreement, any property of the Public Video Service Board shall become the property of the local government units. If a governmental unit chooses to terminate its participation in this agreement prior to the termination of this agreement by all other participating governmental units, that governmental unit forfeits any and all claim to any property of the Public Video Service Board.
