§ 35.04 PROSECUTION FOR VIOLATION.
   If a person issued a notice of violation of a town municipal ordinance denies said violation, then the attorney employed by the town shall prosecute the ordinance violation in a court of appropriate jurisdiction of the county. An ordinance violation is a civil infraction which is to be proven by a preponderance of the evidence. A finding of responsibility for violation of a municipal ordinance is subject to court costs and monetary penalties as prescribed by the ordinances of the town.
