(a) Except where otherwise provided in this Charter, a vacancy shall be deemed to exist in any elective office on the day when the officer dies, files his resignation with the City Clerk-Treasurer, is removed from office, moves from the City, or in the case of a Ward Councilor, moves from the ward he/she represents, is convicted of a felony, or of misconduct in office under the Charter, is judicially declared to be mentally incompetent, or is absent from three (3) regular meetings of the City Council, unless excused by the City Council for cause to be stated in the record of the City Council proceedings.
(b) Except as otherwise provided in this Charter, any vacancy occurring in any elective office shall be filled within thirty (30) days after such vacancy shall have occurred, by the concurring vote of at least four (4) members of the City Council. The person appointed by the City Council shall serve until the next City election.
(c) If at any time the membership of the City Council is reduced to less than four (4), the remaining members may, by majority action, appoint additional members to raise the membership to four (4). Vacancies which occur shall be advertised and applicants shall apply in writing to the City Clerk-Treasurer.
(d) If a vacancy occurs in any appointive office it shall be filled in the manner provided for making the original appointment. In the case of members of boards and commissions appointed for a definite term, such appointments shall be for the unexpired term.
