§ 98.08 SKATEBOARD REGULATIONS.
   (A)   Title. This section shall be known and cited as the “City Skateboard Ordinance.”
   (B)   Definitions. The following words, terms, and phrases, when used in this section, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning.
      DOWNTOWN BUSINESS DISTRICT. Sidewalks on Quincy and Hancock Streets from Reservation to Scott Streets.
      SKATEBOARD. A single platform or surfboard-like object mounted on wheels, which is propelled solely by human power.
   (C)   Prohibited uses.
      (1)   Skateboarding shall be prohibited in the Downtown Business District, except on sidewalks, between the hours of 9:00 a.m. to 9:00 p.m.
      (2)   Skateboarding shall be prohibited in Porvoo Park, the East Hancock historic stairway, Montezuma Street wooden stairway, Church Street wooden stairway, Ravine Street historic stairway, the city beach, the city campground, and City Hall.
      (3)   Skateboarding in the city shall be prohibited upon any wall, handrail, roof, bench, picnic table, planter, monument, retaining wall, barrier and upon any property that may become damaged as a result of skateboarding.
      (4)   Skateboarding shall be prohibited on any city-owned or leased parking lot.
      (5)   Skateboarding on private property without permission of the owner is prohibited.
      (6)   Notwithstanding their status as pedestrians, skateboard operators on sidewalks shall yield the right-of-way to all vehicular and to all other non-skateboard pedestrian traffic upon the sidewalk.
      (7)   No more than one person shall operate or ride on a skateboard at any one time.
   (D)   Penalty. Any person violating any provision of this section shall, upon conviction thereof, be punished by a fine of not more than $100 or 90 days in jail, or both. A person who violates this section is subject to the penalties prescribed for infractions in this section. A police officer or other law enforcement agent may confiscate the skateboard and obtain the person’s name, address, telephone number and age. A skateboard confiscated under this division (D) shall be returned to persons 17 years of age or older not earlier than 24 hours after the violation upon their appearance at the City Police Department and the execution of a declaration of ownership. Skateboards confiscated from those persons under the age of 17 shall be returned not earlier than 24 hours after the violation to the person, parent or guardian upon their appearance at the City Police Department and the execution of a declaration of ownership. If a skateboard is confiscated under this division (D) from a person other than the owner of the skateboard, the skateboard shall be returned, not earlier than 24 hours after the violation, to the owner or the parent or guardian of the owner, if the owner is under 17 years of age, upon the appearance of the owner or the parent or guardian of the owner at the City Police Department and the execution of a declaration of ownership.
