(A) Definition. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
(1) COMMERCIAL PURPOSE. Includes activities which involve the payment of money for the patronage of a commercial activity including those activities sponsored or directed by a profit or non-profit corporation, association or other business entity.
(B) The area which is involved in this section is that portion of the city lying east of Dunstan Street and which has been previously designated as a historical area on the National Register of Historic Places and is known as the East Hancock Neighborhood Historical District, hereinafter referred to as the Historical District. The Historical District is a neighborhood in which many children are engaged throughout the summer months in outdoor activities, and in which many persons participate in walking, jogging or bicycling, many of these on the public streets of the District.
(C) During the months of June, July and August between the hours of 8:00 a.m. and 10:00 p.m., all motor vehicle traffic in the Historical District that has a commercial purpose other than to deliver goods or persons to a residence or business within the Historical District shall be prohibited.
(D) Organizations which are exempt from taxation pursuant to Federal Tax Regulation 501 (c) (3), except those owned by state or local units of government, shall be included in the scope of this section.
(E) Violation of this section shall constitute a misdemeanor.
