§ 155.008 SEVERABILITY.
   (A)   Severability. The invalidity of any clause, sentence, paragraph, or part of this chapter shall not affect the validity of the remaining parts of this chapter.
   (B)   Saving clause.
      (1)   Prosecutions. A prosecution which is pending on the effective date of this chapter or any subsequent amendment and which arose from a violation of an ordinance repealed by this chapter, or a prosecution which is started within one year after the effective date of this chapter or any subsequent amendment arising from a violation of an ordinance repealed by this chapter and which was committed before the effective date of this chapter or any subsequent amendment, shall be tried and determined exactly as if the ordinance had not been repealed.
      (2)   Preliminary site plan approval. If preliminary site plan approval granted under Ordinance No. 437 as amended is properly granted before the effective date of this chapter, nothing in this chapter shall be deemed to require any change in the planned or designed use of any such building, structure, or land if a building permit shall be applied for and granted within one year of the effective date of this chapter and such building shall be entirely completed for its planned or designed use within two years from the effective date of this chapter. Final site plan approval shall be granted under the procedure established by this chapter.
