§ 131.013 ENTRY INTO OR USE OF PROPERTY OF WHICH THE CITY COUNCIL HAD ORDERED TO BE VACATED AND FOR WHICH THE COURT HAS PROHIBITED OCCUPANCY.
   (A)   No person shall enter into any property that has been declared by the City Council to be a nuisance and which the Court has ordered to be vacated and for which occupancy has been prohibited. It shall be an affirmative defense to a prosecution under this section that written permission to enter the property was obtained from the Chief of Police.
   (B)   Whoever violates this section shall be guilty of a misdemeanor and the following minimum criminal penalties which shall be assessed in addition to any other lawful sentence that the sentencing court may impose:
      (1)   For first violation, a fine of not less than $100 nor more than $250;
      (2)   For a second violation, a fine of not less than $300 nor more than $500 and imprisonment for not less than ten days nor more than 90 days; and
      (3)   For subsequent violations, a fine of $500 and imprisonment for 90 days.
