(A) Private landfills; filling of another’s land. No person shall fill any land owned by another person without the permission of the other person or his or her agent.
(B) Condition of landfills. No person owning or controlling any land which is open to public view or access, shall fill, or cause or permit any other to fill, such land unless such owner or person controlling such land keeps the surface free of litter, refuse, waste, junk or other noxious or unsightly material. Provided, however, this provision shall not apply to construction sites where work is progressing under a city building permit.
