(A) All waste accumulated in the city shall be collected by and disposed of by the city or a city designated or licensed contractor, provided that the waste is properly prepared and stored in accordance with the rules. Waste that is not properly prepared and stored in accordance with the rules shall be collected only at additional expense to the property owner. This subchapter shall not prohibit or deny the actual producers of waste, or the owners of premises upon which waste has accumulated, from personally or contracting for the collecting, conveying and disposing of the waste, provided the producers or owners comply with the provisions of this subchapter and the rules.
(B) The city shall permit the transportation of waste through the city provided the vehicles or the containers used to transport the waste do not permit the escape of the waste, give off offensive or unwholesome smells, or shall not otherwise constitute a nuisance. Transportation of garbage or other decomposable refuse shall be in watertight containers.
(C) Any company transporting waste through the city shall obtain a general business license from the City Clerk. Vehicles used for collection and transportation of waste within or through the city shall be plainly marked, watertight, covered and conform to all laws regulating axle and load limitations. The city may designate the route to be taken by trucks or haulers of waste through the city and to a disposal site.
(D) The city shall establish a limit of the amount of refuse regularly collected from nonresidential sources and may require the property owner to contract for private disposal if the limit is regularly exceeded. The property owner shall provide evidence, as determined by the city, of compliance with this order.
(E) The city may not collect waste placed in receptacles that exceeds the weight limitations, is placed outside of the receptacles unless the refuse is considered a bulky item or otherwise does not conform to the provisions of this subchapter or the rules.
(F) The city shall not be responsible for collection of frozen waste adhering to the receptacle or for any resulting damage to receptacles.
