(A) Generally. SHALL is always mandatory. Masculine forms shall include the feminine. Singular forms shall include the plural.
(B) Definitions. For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
BULK REFUSE CONTAINER. Includes containers, roll-off dumpsters, boxes, shipping containers and other containers used to hold things for transport or storage holding over eight cubic yards, including licensed vehicles or trailers parked in the right-of-way overnight.
CITY. The City of Hamtramck, Wayne County, Michigan.
CODE OFFICIAL. Any person authorized to enforce this subchapter or his or her designee.
COMMERCIAL REFUSE. A solid waste material resulting from the rejected, unwanted, discarded or abandoned material generated by commercial establishments and industrial establishments and uses, such as office buildings, personal service establishments, technical and scientific research facilities, professional service offices, clinics, schools and churches. The definition includes REFUSE.
CONSTRUCTION REFUSE. All unwanted, rejected, discarded, abandoned or surplus materials resulting from the alteration, repair, demolition or construction of buildings or structures.
GARBAGE. Decomposable animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food.
HAZARDOUS WASTE. Any substance defined as a hazardous substance or hazardous waste under any federal or state law or regulation.
LITTER. All waste, offal, paper, glass, cans, bottles, trash, debris or other foreign substance of every kind and description.
MECHANICAL CONTAINER. Any dumpster or other refuse container with a capacity of two cubic yards or greater used to store refuse which is capable of being emptied by mechanical means; this includes gondola-type containers.
PERSON. Any individual, natural persons, partnerships, joint adventures, societies, associations, clubs, trustees, trusts or corporations; or any officers, agents, employees, factors or any kind of person representatives of any thereof, in any capacity, acting either for himself, herself or for any other person under either personal appointment or pursuant to law.
PRIVATE PROPERTY. Any dwelling, house, building or other structure designed or used, either wholly or in part, for private residential purposes, whether inhabited or temporarily or continuously uninhabited or vacant and shall include any yard, grounds, walk, driveway, porch, steps, vestibule or mailbox belonging or appurtenant to the dwelling, house, building or other structure.
PUBLIC PROPERTY. Any and all streets, sidewalks, boulevards, alleys or other public ways, gutters, sewers and any and all public parks, squares, spaces, grounds, buildings and city-owned real property.
REFUSE. All decomposable and non-decomposable solid wastes, except body wastes, including garbage, rubbish and ashes.
RUBBISH. Non-decomposable solid wastes, excluding ashes, consisting of both combustible and noncombustible wastes, such as paper, cardboard, tin cans, yard clippings, wood, glass, bedding, crockery and similar materials.
RULES. The policies and procedures established by the city in accordance with this subchapter.
SPECIAL COLLECTION. Any collection of waste at a time other than the regularly scheduled once per week collection, or of a volume or quantity of waste exceeding the limitations of this subchapter whether requested by an owner or occupant or done by the city to eliminate a violation of a city ordinance.
VEHICLE. Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, including devices used exclusively upon stationary rails or tracks.
WASTE. Refuse or yard waste.
YARD WASTE. Residential grass clippings, leaves, weeds, twigs, prunings, shrub clippings, garden waste, old potting soil and dirt incidental to minor yard work, Halloween pumpkins, brush, branches, tree trimmings, Christmas trees and small shrubs and bushes with dirt removed from root systems. Christmas trees shall not be considered yard waste during the months of December and January.
YARD WASTE COLLECTION SEASON. A period each year scheduled by the city during which a separate yard waste collection service is provided throughout the city.
